Terms and Conditions of Sale (CGV)

Between businesses, any seller must provide its CGV to any business buyer who requests them (art. L441-1 of the Code de commerce, French Commercial Code). Toward consumers, the pre-contractual information obligation makes CGV de facto indispensable for any e-commerce site or distance selling (art. L221-5 of the Code de la consommation, French Consumer Code).

Article L221-18 of the Code de la consommation (French Consumer Code) grants the consumer a 14-calendar-day withdrawal period for any contract concluded at a distance or off-premises. This right does not apply to B2B contracts. If this information is omitted, the period is extended by 12 months.

The legal warranty of conformity (art. L217-3 of the Code de la consommation, French Consumer Code) covers conformity defects present at the time the goods are delivered, for two years for new goods. The warranty against hidden defects (art. 1641 of the Code civil, French Civil Code) covers defects that make the goods unfit for their intended use, even if they appear after the sale, within 2 years of their discovery.

Yes. The Code de la consommation (French Consumer Code) provides for statutory exceptions: products made to the consumer's specifications, audio/video recordings or software unsealed after delivery, digital content supplied immediately with express consent, perishable goods, and so on. These exceptions must be explicitly stated in your CGV.
