Furnished residential lease
The furnished lease for use as a main residence is governed by the loi du 6 juillet 1989. It applies to a decent property fitted with sufficient furniture so that the tenant can live there normally. Its term is in principle one year (nine months for a student), renewable, and the security deposit (dépôt de garantie) may not exceed two months' rent excluding charges. The contract sets out the rent, the charges, the term and the respective obligations of the parties. What is the term of a furnished lease?
The minimum term is one year, renewable by tacit renewal. It is reduced to nine months, non-renewable, when the tenant is a student. The tenant may give notice at any time with one month's notice.
What security deposit can I ask for?
For a furnished letting, the security deposit (dépôt de garantie) is capped at two months' rent excluding charges. It is returned within a maximum of one or two months after the keys are handed back, depending on the exit inventory of fixtures (état des lieux).
Must the property contain specific furniture?
Yes. Décret n° 2015-981 sets a minimum list: bedding with a duvet, hobs, an oven or microwave, a fridge, crockery, utensils, a table, seating, storage, lighting and cleaning equipment. Failing this, the lease may be reclassified as an unfurnished letting.
Is an inventory of fixtures mandatory?
Yes, an entry and exit inventory of fixtures (état des lieux) must be drawn up jointly and attached to the lease, together with an inventory of the furniture. They govern the return of the security deposit (dépôt de garantie).
