The law does not formally require CGU to be drafted, but the LCEN (French digital economy law) makes legal notices (mentions legales) mandatory for any website publisher. The CGU complement these notices by setting the contractual framework for use. For any online service involving account creation, they are indispensable to frame the relationship with users.
What is the difference between CGU and CGV?
The CGU (terms of use) govern the use of a service or platform (access, account, rules of conduct). The CGV (terms and conditions of sale) frame commercial transactions (sale, payment, delivery, warranties). An e-commerce site must have both; a showcase site or a free service can be limited to CGU.
How are the CGU enforceable against users?
To be enforceable, the CGU must be brought to the user's attention before using the service, in a clear and accessible manner. The practice of a checkbox reading 'I accept the CGU' at account creation provides the strongest proof of acceptance.
Must the CGU mention the privacy policy?
