Unfurnished residential lease

The unfurnished residential lease (location nue) is the contract governing the letting of an unfurnished property for use as a main residence. Governed by the loi du 6 juillet 1989, it is subject to protective rules of public order: a minimum term of three years when the landlord is an individual, a security deposit (dépôt de garantie) capped at one month's rent excluding charges, a reduced notice period for the tenant in certain cases, and tacit renewal. The contract must reproduce the mentions of the regulatory standard contract. This template covers its essential clauses. Frequently asked questions

What is the minimum term of an unfurnished lease?

Three years when the landlord is a natural person (or a family SCI), six years when it is a legal entity. At the end of the term, the lease is tacitly renewed. The landlord may only give notice to sell, to take back the property or for a legitimate and serious reason, with six months' notice.

What is the maximum amount of the security deposit?

For an unfurnished letting, the security deposit (dépôt de garantie) may not exceed one month's rent excluding charges. It is returned within one month after the keys are handed back if the exit inventory of fixtures (état des lieux) matches, two months in the event of damage.

What notice period for the tenant?

The tenant may leave at any time with three months' notice, reduced to one month in a tight housing area (zone tendue), in the event of relocation, job loss, first job, health reasons justifying a move, or receipt of the RSA/AAH. The landlord, for their part, may only give notice at the end of the term.

Must documents be attached to the lease?

Yes: the technical diagnostics file (DPE, lead, asbestos, electricity, gas, risks...), the information notice, the entry inventory of fixtures (état des lieux) and, in a co-ownership, an extract from the regulations concerning the common areas. These annexes supplement this contract.
