Does the solidarity clause apply after a co-tenant leaves?
Yes, but for a limited time. Under article 8-1 of the law of 6 July 1989, a co-tenant who gives notice remains jointly liable for the payment of rent and charges for a period of six months from the effective date of the notice, unless a new co-tenant is approved by the landlord before this period expires.
Can a co-tenant give notice without all the others leaving the dwelling?
Yes. The colocation is specifically designed to allow the individual departure of a co-tenant. The lease continues by operation of law between the landlord and the remaining co-tenants. The departure of one co-tenant does not terminate the lease.
What is the minimum term of a shared tenancy contract?
The minimum term is the same as for a standard lease: three years for an unfurnished dwelling, one year for a furnished dwelling. The same notice periods apply.
Is the security deposit individual or shared?
The security deposit (depot de garantie) is in principle paid to the landlord as a whole. The split between co-tenants is an internal matter. It is returned within the statutory time limits after all co-tenants have handed back the keys.
