Is the rental of a garage subject to the 1989 law?
No, provided the garage or space is rented on its own, independently of any dwelling. The contract then falls under the Code civil: term, notice and security deposit are freely set. However, if it is rented together with the dwelling of the same landlord, it follows the residential lease regime.
What notice applies to terminate?
The notice is the one provided in the contract, freely set by the parties (often one month). If none is stated, a reasonable period must be observed. Termination is done by registered letter with acknowledgment of receipt.
Can a security deposit be requested?
Yes, its amount is unrestricted since the statutory cap for residential leases does not apply. It is returned at the end of the rental, less any sums owed or damage.
Does VAT apply?
The rental of a parking space may be subject to VAT when the landlord is a taxable person. Between private individuals, it generally does not apply. The contract states the agreed rent.
