The seasonal rental contract (location saisonniere) governs the rental of a furnished dwelling for a short period, to a transient clientele who do not take up residence there. Entered into for a maximum period of ninety days, it falls outside the standard residential lease regime. The contract specifies the stay dates, the price, the terms for paying the down payment (acompte) or forfeitable deposit (arrhes), the security deposit, the occupancy capacity and the cancellation conditions. A descriptive statement of the dwelling must be given to the tenant before the contract is concluded. What is the maximum term of a seasonal rental?
A seasonal rental is entered into for a maximum of 90 consecutive days with the same tenant. Beyond that, it no longer falls under the seasonal regime. The dwelling is rented to a transient clientele who do not make it their main residence.
What is the difference between acompte and arrhes?
With arrhes (a forfeitable deposit), each party may withdraw: the tenant loses the arrhes if they cancel, the landlord repays double if they back out. With an acompte (down payment), the commitment is firm and cancellation may entail payment of the full amount. Without any specification, sums paid are presumed to be arrhes.
Is a descriptive statement mandatory?
Yes. The Code du tourisme requires the prior provision of a descriptive statement of the dwelling stating its location, its contents and its price. An entry and exit inventory of fixtures (etat des lieux) is also recommended to manage the security deposit.
Can a security deposit be requested?
Yes, its amount is unrestricted. It is returned at the end of the stay, after the inventory of fixtures, less any damage. It should not be cashed if given merely as a guarantee.
