The sale contract for a used vehicle between private individuals formalises the agreement between the seller and the buyer: it sets out the vehicle's specifications, the price, the mileage and the condition of the property. Does this contract replace the certificat de cession (transfer certificate)?
No. The certificat de cession (transfer certificate, CERFA form no. 15776) remains mandatory for the vehicle registration (carte grise) procedure and must be declared online on the ANTS website (the French national agency for secure documents). The sale contract complements it by detailing the agreed terms and serves as proof in the event of a dispute.
Is a private seller bound by any warranty?
Between private individuals, the statutory warranty of conformity does not apply, but the warranty against hidden defects (vices cachés, article 1641 of the Code civil) remains. The seller must not conceal a defect that renders the vehicle unfit for use.
Which documents must the seller hand over?
The carte grise (registration document) crossed out with the note 'vendu le...' (sold on...) and signed, the certificat de cession (transfer certificate), a certificat de situation administrative (administrative status certificate, or non-gage) less than 15 days old, and the roadworthiness inspection report less than 6 months old for a vehicle over 4 years old.
Can a vehicle be sold 'as is'?
Yes, the note 'vendu en l'etat' (sold as is) can be added to indicate that the buyer accepts the vehicle in its current condition, but it never exempts the seller from liability for hidden defects (vices cachés) that they were aware of.
