Internship agreement (convention de stage)

The convention de stage (internship agreement) is the tripartite document signed by the host company, the intern and the educational institution which provides the legal framework for the internship. It is made mandatory by articles L124-1 et seq. of the Code de l'education for any internship carried out as part of a course of study. It sets out the tasks assigned, the duration, the hours, the gratification (stipend) and the supervision arrangements. Its absence may expose the company to reclassification of the relationship as an employment contract. Is the gratification mandatory for all internships?

The gratification becomes mandatory as soon as the internship exceeds two months, consecutive or not, during the same school or university year. Its minimum amount is set each year by ministerial order and corresponds to a percentage of the hourly social security ceiling. Below two months, the gratification is optional.

What is the maximum duration of an internship?

An internship may not exceed six months per year of study within the same host organisation (article L124-5 of the Code de l'education). Internships shorter than two months are not subject to this rule but must remain consistent with the educational project.

Does the intern have employee status?

No. The intern is not an employee. They cannot be assigned tasks corresponding to a permanent job and do not benefit from the Code du travail, except for the provisions expressly extended to interns (protection against discrimination, maximum working hours, leave for long internships, etc.).

What happens in the event of a workplace accident?

The intern is covered by workplace accident and occupational illness insurance under the general scheme, through the contributions paid by the educational institution when the gratification does not exceed the threshold for social contributions, or by the host company above that threshold.
