Resignation letter (lettre de demission)

The lettre de demission (resignation letter) is the document by which an employee on a CDI notifies their employer of their decision to end the employment contract on their own initiative. It does not need to give reasons, but must express a clear and unequivocal intention to resign, so as to avoid any dispute. It triggers the notice period (preavis), whose length depends on the convention collective, the contract or custom. A dated letter, handed over in person against receipt or sent by registered post, secures the leaving date. Is a resignation letter mandatory?

The law does not require writing to resign from a CDI, but writing is strongly recommended: it proves the clear intention to end the contract and fixes the start date of the notice period (preavis). Without writing, the resignation may be contested.

Do I have to give reasons for my resignation?

No. The employee does not have to justify their decision to resign from a CDI. It is even preferable not to raise complaints against the employer, which could lead to the termination being reclassified. A neutral wording is enough.

How long is the notice period (preavis)?

It depends on the convention collective, the employment contract or the customs of the profession, and often on length of service. Check your convention. The employer may agree to waive all or part of the notice period.

Can I go back on my resignation?

A clear and unequivocal resignation is in principle final. A retraction is only possible with the employer's agreement, or if the resignation was given in the heat of emotion or under pressure (in which case it may be contested).
