The procuration (power of attorney), or mandate, is the act by which one person (the mandant / principal) authorises another person (the mandataire / agent) to carry out a task in their name: collecting mail or a parcel, carrying out a banking operation, representing the principal before an administration, signing a specific document. To be effective, it must clearly identify both parties, specify the exact object of the power granted and its duration. Certain tasks (property sale, notarial deed) require an authenticated power of attorney drawn up by a notary. Frequently asked questions
Is a private power of attorney (acte sous seing prive) sufficient?
For most everyday tasks (mail, banking, administration), a power of attorney written on plain paper, dated and signed, accompanied by the ID documents of both parties, is sufficient. However, formal acts such as a property sale require a notarised power of attorney.
Do ID documents need to be enclosed?
Yes, it is strongly recommended and often required: the power of attorney must be accompanied by a copy of the ID document of the mandant (principal) and that of the mandataire (agent), so that the organisation can verify both signatures.
Can I limit the power of attorney to a single task?
Yes, and it is even advisable. A power of attorney should be as precise as possible: state the exact object ('collect such parcel', 'consult such file'). A mandate that is too general may be refused or misused.
How can a power of attorney be ended?
The mandant (principal) can revoke the power of attorney at any time by informing the mandataire (agent) and the organisation concerned. The mandate also ends at its term, upon completion of the task, or on the death of either party.
