Receipt for solde de tout compte (final settlement)

The recu pour solde de tout compte (receipt for final settlement) is the document that the employer draws up and gives to the employee on termination of the employment contract, whatever the reason. It lists all the sums paid to the employee on their departure: final salary, indemnites, compensation for paid leave. Drawn up in duplicate, it acquires a discharging effect for the employer if the employee does not challenge it within six months of signing. This form is in English, but the document is generated in French, ready to sign and use in France.

Frequently asked questions

Is the receipt for solde de tout compte mandatory?

Yes, the employer must draw it up and give it to the employee on termination of the contract, whatever the reason (resignation, dismissal, end of CDD, rupture conventionnelle). The employee, however, is not obliged to sign it.

What happens if the employee signs it?

The signature starts a six-month period. After that period, the receipt becomes discharging for the employer: the employee can no longer challenge the sums stated in it. The receipt must state this signature date.

Can the employee challenge after signing?

Yes, but only within six months of signing, by a reasoned registered letter. Beyond that, only sums not stated in the receipt remain challengeable. An unsigned receipt can be challenged during the ordinary limitation periods.

In how many copies?

The receipt is drawn up in two copies, one of which is given to the employee. This mention must appear on the document itself.
